Hereby statute describes principles of sale conducted through sale website named as www.lgwater.pl
§ 1 Definitions
Working days – days from Monday to Friday with exception of days statutory free of work.
Consumer – physical or lawful body dealing with seller, through sale website, within lawful act
user – unpayable sale website functionality (service) permitting buyer to settle individual user account on sale website. Such service is regulated in accordance with separate and accessible statute.
Buyer – each subject executing purchase in the shop.
Statute – hereby statute.
Sale website – conducted by seller under the following address www.lgwater.pl

§ 3 Purchase order
In order to set up a sale agreement, through the shop, in first step you should add goods to the basket.
Next, the buyer inputs his/her data (including delivery address), selects way of payment for the purchase and method of delivery.
Once the buyer confirms the order and statute the sale agreement is entered into force.
Each buyer can submit his/her order on the sale website (it means to make a sale agreement) with use of User Account or with omitting of establishment of User Account through input his/her data in given order formula attached to the sale website.
§ 4 Cost of order
Prices given in the sale website are gross prices, it means including VAT (Value Added Tax).
Total price of order consists of price of goods and cost of delivery described on the sale website.
§ 5 Payments
1. For goods purchased through sale website the Buyer can pay, depending on selected method of payment, once the order is submitted:
a) through transfer to the Seller banking account number: 27 1090 1841 0000 0001 1994 6776
b) through banking card or transfer through payment platform named as Przelewy24
c) through cash, it means at time of delivery to courier.
2. Once the Buyer selected method of payment which is stated at point 1. a) or b) the order should be paid within 3 working days since conclusion of the sale agreement.
§ 6 Execution of order
Goods purchased, depending on method of delivery selected by the Buyer at time of order submission, are delivered through courier companies, with restrictions stated at point 2.
The Buyer, once such option is selected at time of order submission, may personally collect goods in the Seller store, after telephone agreement with the Seller.
The Seller makes all possible efforts the orders to be executed within the quickest way – the maximal deadline of the order execution is up to 5 working days.
Once the Buyer selected personal collection of goods the day of delivery means the day when the goods are ready to be collected in the Seller’s store.
The day of order execution is counted from the day when the sale agreement is set up.
Once the order is consisted of a few products the deadline of execution of entire order is counted in accordance with the longest term of delivery.
Once the Buyer decided on payment which is described in § 5 point 1 letter a) or b) initiation of order execution is triggered after receipt payment by the Seller for the purchased goods.
Goods delivered are generally within the territory of the Republic of Poland. In case of foreign deliveries costs, ways of transport and terms of deliveries are agreed individually with the Buyer.
The Seller is obliged to deliver goods free of defects.
§ 7 Agreement waiver
The Consumer has the right to waive from sale agreement, with restrictions stated at § 8 point 1 of the statute within 14 days without any justification.
Deadline of agreement waiver expires after 14 days counting from the day,:
a) on which the Consumer possessed the subjected goods or when the third party other than courier and subject directed by the Consumer possessed the goods.
b) on which the Consumer possessed the last from the goods or on which the third party other than the courier and directed by the Consumer possessed the last from the goods in case of agreement obliging transfer of numbered goods possession which are delivered separately.
Within the right of agreement waiver The Consumer must inform the Seller, using the data given in the statute, about his/her decision to waive the sale agreement through unambiguous announcement ( for example through a letter sent by post office or information sent through email).
To keep the term of sale agreement waiver the Consumer shall send information concerning execution the right of agreement waiver before the expiry date of such agreement waiver.
In case of agreement waiver the Seller shall return the Buyer all received payments, including costs of delivery ( with exception of additional costs resulted in selected by the Buyer method of delivery other than the cheapest usual way of delivery offered by the Seller), immediately afterwards, in each case not later than within 14 days since the day the Seller is informed by the Buyer about his/her decision on agreement waiver.
The Seller executes return of payment with use of the same method of payment which is used by the Buyer in originated transaction, unless the Buyer agrees with other solution, in any case the Buyer shall not pay any charges concerning the subjected return.
The Seller may hold the return of payment until receipt of the goods or confirmation of return proof depending on which one occurs first.
The Seller requests for returns of goods on address given in § 2 point 1 of the statute, immediately, in any case not later than within 14 days since the day the Buyer informed the Seller about agreement waiver. The term is treated as kept when the Buyer resends the goods within 14 days.
The Buyer bears direct costs of goods return.
The Buyer is responsible for only value decrease of goods resulting from their use other than it is necessary to identify their characteristics, features and functionalities.
§ 8 Agreement waiver – exclusion
The right of agreement waiver is not entitled to the Buyer in relations with the following agreements:
a) in which the goods belong to the category of fast decay or having short expiry date;
b) in which the subject of service is a good delivered in sealed wrap, which, after opening, is not to be returned due to health care or hygienic issues, when the wrap is opened after delivery;
c) in which the subject of service are the goods which after delivery, due to their characteristics are inseparable with other goods;
d) in which the subject of service is prefabricated good, produced in accordance with the Buyer’s specification or targeted at his/her individual requirements.
§ 9 Complaints
Once occurrence of faulty goods the Buyer has the right to complain the faulty goods basing on pledge warranty regulated by the Civil Code.
1. In case of occurrence of faulty goods the Buyer has the right, in accordance with terms and principles defined in the Civil Code:
a) submit announcement on price decrease,
b) in case of significant faulty – submit announcement on agreement waiver,
c) demand replace of good on free from faults,
d) demand remove of faults.
2. The Seller requests complaints submitted basing on pledge warranty to send through email or in writing form on the appropriate address given in § 2 of the statute.
3. In order to consider the complaints submitted basing on pledge warranty the Buyer is obliged, when necessary, to deliver on cost of Seller the faulty goods on postal address of the Seller given in § 2 of the statute.
4. The Seller recommends the complaint announcement to input the following data: identifying data of the Buyer, concise description of faults, time of faults identification and complaint requirements of the Buyer.
5. Each Seller’s recommendation which is described in the statute is of unbounded direction which the Buyer may use or not. Not using the Seller’s recommendations shall not impact on the Buyer’s rights in any case, especially in the rights concerning pledge warranty.
6. Complaints concerning the shop functionalities should be submitted through electronic way on email address given in § 2 point 2 of the statute.
7. The Seller shall respond to the complaint within 14 days.
§ 10 Extrajudicial methods of complaints consideration and claims awarding
The Consumer is available to use the following, among others:
a) Mediations conducted by Principalities Inspectorates of Trade Inspections;
b) Assistance of permanent conciliatory consumers courts acting with Principalities Inspectorates of Trade Inspections;
c) Internet ODR platform on address http://ec.europa.eu/consumers/odr/
§ 11 Personal data
The personal data administrator of Buyers given to the Seller at time of purchasing process is the Seller.
Giving the personal data by the Buyer at time of purchasing process, including the moment of user account settlement, on sale platform www.lgwater.pl is entirely voluntary, but necessary for order execution.
The Buyer has the right to verify his/her personal data along with requirements of their correction.
Given by the Buyer his/her personal data at time of order submission shall be processed by the Seller only in accordance with the terms given in the paragraph.
The Buyer has the right to resign from the user account at any time without any justification and without bearing any costs. In order to do that the Buyer should send to the Seller on email address: biuro@epsolution.pl his/her resignation what shall result in immediate removal of user account along with agreement termination in the area.
§ 12 Technical requirements
In order to use sale website www.lgwater.pl computer equipment with internet browser and internet access is necessary. For user account settlement and purchase process an active email account is also necessary.
§ 13 Final remarks
The sale agreement signed in accordance with the subjected statute concerns only specific and expandable order – is signed in order and time of its execution. Each order requires separate acceptance of the statute.
Agreements signed through the sale website are in Polish or English language.
Delivery of unlawful contents by the Buyer is forbidden.
